 ‘Chicken Bill’ Language Removed

Thanks to your support in joining SCHOA to oppose Senate Bill SB1582, the language which would have overridden HOA Deed Restrictions by giving property owners of single family detached homes the ability to house up to six chickens and a coop as large as 200-square-feet and up to 8-foot-tall in their yards – has been taken out of the bill.

On Tuesday, May 5, the Arizona House of Representatives voted to amend the bill to exclude all of the language allowing chickens and a large chicken coop, in yards.

Due our successful efforts, SCHOA has stopped collecting petition signatures at this time. They may try to do this again in the next legislative session, so we’ll be watching.

What’s Left in SB 1582

As amended on May 5, SB 1582 continues to include the other provision that could impact our Condo Associations. The language seeks to prohibit these associations’ ability to restrict household dogs or cats based on breed, size, or weight, and making any such existing rules unenforceable. HOUSEHOLD PETS

The bill continues to include language that would prohibit Title 33 HOAs from restricting household dogs and cats based on breed, size, or weight, and making any such existing rules unenforceable. This section would impact Title 33 associations.

ISSUES THAT HAVE BEEN TAKEN OUT OF THE BILL ON MAY 5, 2026 THANKS TO YOUR VOICE (We will watch that the following does not return in a future bill):

  • Would have stripped away local control from homeowners who know what is best for their community. Deed restrictions are in place to protect property values for all.
  • Would have allowed single family detached homes to house up to six chickens in the side yard or backyard despite deed restrictions against it.
  • Would have allowed a coop structure as large as 200 square feet – roughly the size of a large master bedroom – and as tall as 8 feet high, two feet or more taller than fences and walls approved in Sun City.
  • Provided nothing in the bill stating that permits would be needed, though generally anything built needing electricity in Sun City would need a permit from Maricopa County.
  • Didn’t specify what type of material that should be used to build the coops.
  • Included requirements regarding cleanliness, control and safety of the chickens. However, the bill did not define or fund the enforcement authority over those standards.
  • The lack of enforcement ability over livestock conditions would open up neighborhoods to new odors, noise, and pest attraction such as rats and flies, which bring additional health and safety risks.
  • Chickens also attract predators, such as coyotes. And as our community is aware, we already have an issue with coyotes preying on small animals.
  • This is an overreach by the Arizona Legislature that would create a dangerous new precedent that could allow future challenges on important HOA contracts and deed restrictions.
  • To be clear, this bill would affect HOAs that are under the authority of Title 33. The Sun City Home Owners Association (SCHOA) is legally a non-profit corporation under the authority of Title 10. While this bill may not directly affect SCHOA initially, we want to protect our community in the case that this is challenged. Litigation is extremely expensive and SCHOA prefers to avoid that if possible.

Also, for clarity, though it shows Senator Payne as the sponsor of this bill, he DID NOT sponsor this. This bill originally had different language which passed out of the Senate. Once in the House the original language was striped and the bill is being used as a Striker bill. Doing this, Representative Matt Gress attached his language to this bill, completely changing it. Senator Payne was never approached about this and adamantly opposes it.
